Terms and Conditions

By ordering from our website you agree to the follow Terms of service set by . PhotoByte LLC -(Updated 6/10/2025)


  • Our business offers digitalization of photos and film reels, we will provide the link to download the content  for 90 days from the finalization of the sale, due to storage costs we will not hold your data for longer than 90 days.
  • All of your personal data is held in an encrypted cloud, after 90 days this data is removed - this is to protect your privacy.
  • All content, trademarks, logos, and intellectual property on your website/products belong to PhotoByte LLC  (or its licensors) 
  •  Any dispute arising out of or related to these Terms or the Service shall be resolved through  Arbitration . 
  • The Service is provided on an 'AS IS' and 'AS AVAILABLE' basis. PhotoByte LLC makes no warranties, whether express or implied, regarding the Service, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
  •  In no event shall PhotoByte LLC , nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose." 
  • Services are only offered to residents of Kentucky, we reserve the right to cancel / refund out of state orders.
  •  The laws of the State of Kentucky, without regard to its conflict of law provisions, shall govern these Terms. 
  •  PhotoByte LLC reserves the right to modify these Terms at any time. 


Privacy Policy

All Information sent to us, digitized or pulled will be deleted from our cloud accounts after 90 days. Information will not be shared, however if you use a 3rd part such as Apple Pay or Google Pay we cannot ensure all data is private.


Under no circumstances will your personal information, photos etc be shared with anyone without prior consent, consent would only be requested to use as examples etc.


PhotoByte LLC will not be held liable for any unintentional leaks or breaches resulting in the information, data or photos shared with us becoming public.


PhotoByte LLC reserves the right to modify these Terms at any time. 

Shipping Policy

Upon ordering a product we will work on generating a shipping label for you which will be paid for by us.


We will however not provide materials for shipping, this includes boxes, packing materials, etc.


We will not provide any re-imbursement for costs related to shipping such as gas costs, or any other costs related to delivering the package to a drop off point.


Once the final invoice has been paid (On digitalization services)  we will pay for and ship back your media in the same packaging used to send to us.


If the service had a flat charge such as retrieving unencrypted data off of legacy media we will ship that back.


All communications will come from  support@photobyte.net .


PhotoByte LLC reserves the right to modify these Terms at any time. 

Returns and Refunds

As a small family owned business, chargebacks, refunds and returns hurt us. We will work with you on what we can do to ensure that you are happy with your service and that we still remain profitable.

Grounds for termination of service

If we receive or pull illegal content including but not limited to depictions of Violence, Child Pornography, Depictions of  Use Drug use, etc. Action will be taken this can range from refusal to digitize or upload to our cloud, to contacting the proper  authorities and providing the media as proof.


We will not digitize copyrighted material.


If we cancel service in this way no refunds will be given.
